Roger Rogoff is the latest in a series of\u00a0judicially appointed U.S. attorneys to be ousted by the Trump administration\u00a0from their posts but is believed to be the first of that group to sue over the removal. His action creates a first-of-its-kind court case that will test the Justice Department\u2019s authority to fire federal prosecutors who are appointed by judges,<\/p>\n
Rogoff was unanimously appointed to the job of U.S. attorney for western Washington by the federal judges in the district. But shortly after he was sworn in last Wednesday, he received an email from the Trump administration informing him that President Donald Trump had ordered his termination.<\/p>\n
The lawsuit contends that the abrupt firing was unconstitutional and disregarded the authority of the judges of the district to name Rogoff to the job until the vacancy could be filled through a Senate-confirmed nominee. The complaint seeks a court order declaring that the firing \u201cwas unlawful and is void\u201d and that Rogoff at least temporarily remains U.S. attorney.<\/p>\n
\u201cThe President\u2019s actions violate the law, and they ignore the protections of the Constitution of the United States,\u201d Rogoff said in a statement issued through the law firm representing him. \u201cHis removal of me, like his removal of other court-appointed U.S. attorneys across the country, is illegal and cannot stand.\u201d<\/p>\n
US attorneys are typically nominated by the president<\/h4>\n
U.S. attorneys, top federal prosecutors who oversee regional Justice Department outposts across the country, are typically nominated by the president and then confirmed by the Senate.<\/p>\n
In the case of a vacancy, attorneys general have the authority to name an interim U.S. attorney who can serve for 120 days, but when those temporary appointments expire, the judges in a judicial district are then empowered to name a U.S. attorney \u2014 as happened in Rogoff\u2019s case \u2014 who can serve until the selection of a Senate-confirmed appointee.<\/p>\n
But under Trump, the Justice Department has sought to leave unconfirmed prosecutors in their positions indefinitely or has moved to fire prosecutors appointed by the courts.<\/p>\n
The acting attorney general had foreshadowed the firing<\/h4>\n
Rogoff\u2019s district has not had a Senate-confirmed U.S. attorney since 2023. He submitted his name for consideration with the federal bench after the judges last January signaled their intent to fill a vacancy created by the end of the 120-day term of Charles Neil Floyd, who had been named to the job in an interim capacity last year by then-Attorney General Pam Bondi.<\/p>\n
Even before Rogoff was appointed, the lawsuit notes, acting Attorney General Todd Blanche foreshadowed his plans to fire whomever the judges selected, writing on X after the court announced its appointment of a merit selection panel that the candidates did not have the president\u2019s support, \u201cand I expect they will suffer the same fate as others have when judges ignore Article II\u201d of the Constitution.<\/p>\n
After Rogoff was fired, Blanche posted: \u201cDistrict court judges can appoint a temporary U.S. Attorney, and POTUS can fire them.\u201d Judges from the state\u2019s western district, he said, \u201cabandoned the time-honored process of consultation with the administration so that the selected U.S. Attorney is qualified to serve in the administration. Roger Rogoff has been fired by the President.\u201d<\/p>\n
The Justice Department said in a statement Tuesday that \u201cthe district court did not coordinate with DOJ on this selection. Consistent with other firings of this type, this is wholly within the President\u2019s authority.\u201d<\/p>\n
Other jurisdictions that have seen tussles between the judiciary and the administration over the prosecution posts include New Jersey, where Trump\u2019s former personal lawyer,\u00a0Alina Habba, resigned in December after an appeals court\u00a0said she had been serving in the post unlawfully.<\/p>\n
Lindsey Halligan, another of Trump\u2019s personal lawyers who was installed by the administration, left her position as an acting U.S. attorney in Virginia after a\u00a0judge concluded\u00a0her appointment was unlawful and that\u00a0indictments she brought\u00a0against\u00a0New York Attorney General Letitia James\u00a0and\u00a0former FBI Director James Comey\u00a0must be dismissed.<\/p>\n<\/div>\n
